Terms of Service

Last Updated: January 2024

1. Acceptance of Terms

Welcome to JoySprout Park. By accessing and using our facilities, website, and services, you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and JoySprout Park. If you do not agree to these terms, please do not use our services or facilities. We reserve the right to modify these terms at any time, and your continued use of our services constitutes acceptance of any modifications.

2. Park Access and Admission

JoySprout Park welcomes families, children, educators, and nature enthusiasts to our garden-themed entertainment facilities. All visitors must comply with park rules and staff instructions at all times. We reserve the right to refuse admission or remove any visitor who violates these terms, engages in unsafe behavior, or disrupts other guests' enjoyment. Children must be supervised by responsible adults at all times. Visitors agree to respect all posted signs, barriers, and restricted areas within the park premises.

3. Safety and Conduct

Guest safety is our highest priority. All visitors must follow posted safety guidelines and instructions provided by our staff members. Parents and guardians are responsible for supervising their children throughout their visit. Running in designated quiet zones, climbing on restricted structures, or interfering with plant displays is prohibited. Visitors should wear appropriate footwear and clothing suitable for outdoor activities. Any unsafe behavior may result in immediate removal from the premises without refund or compensation.

4. Use of Facilities

Our facilities including planting zones, play areas, workshops, and gardens are provided for the enjoyment and education of all guests. Visitors agree to use equipment and facilities as intended and instructed by staff. Damage to plants, structures, or equipment whether intentional or through negligence may result in liability for repair or replacement costs. We maintain the right to close any facility or area temporarily for maintenance, special events, or safety concerns without prior notice.

5. Photography and Media

JoySprout Park may photograph or video record activities within the park for promotional, educational, and operational purposes. By entering the park, you consent to being photographed or recorded and grant us the right to use such images in our marketing materials, website, and social media channels. If you prefer not to be photographed, please inform our staff members. Personal photography for private use is permitted, but commercial photography requires prior written permission from park management.

6. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of JoySprout Park and protected by intellectual property laws. Our park name, logo, and distinctive garden designs are registered trademarks. You may not reproduce, distribute, modify, or create derivative works from our content without explicit written permission. Educational materials provided during workshops may be used for personal educational purposes only.

7. Liability and Assumption of Risk

While we maintain safe facilities and provide supervision, participation in outdoor activities involves inherent risks. Visitors assume all risks associated with their visit including but not limited to injuries from physical activities, allergic reactions to plants or insects, and exposure to weather conditions. JoySprout Park, its owners, employees, and contractors are not liable for injuries, losses, or damages except where caused by our gross negligence or willful misconduct. We strongly recommend appropriate insurance coverage for all visitors.

8. Personal Property

JoySprout Park is not responsible for lost, stolen, or damaged personal property. Visitors should secure their belongings and avoid bringing valuable items to the park. Lost and found items are held for thirty days before being donated or disposed of. We recommend labeling children's belongings with names and contact information. The park provides secure storage lockers at various locations for guest convenience, used at visitor's own risk.

9. Health and Medical Conditions

Visitors with medical conditions, allergies, or physical limitations should inform staff before participating in activities. While our staff includes trained first-aiders, we are not medical professionals. Parents must disclose any conditions that might affect their child's safe participation in activities. We maintain the right to exclude individuals from specific activities if we believe participation poses health or safety risks. Emergency medical services will be contacted immediately for serious injuries or medical emergencies.

10. Prohibited Items and Activities

For the safety and enjoyment of all guests, certain items and activities are prohibited. These include weapons of any kind, illegal substances, alcohol, outside food in designated areas, pets except registered service animals, drones or remote-controlled devices, and any items deemed dangerous by park management. Smoking and vaping are prohibited throughout the park. Violation of these prohibitions may result in immediate expulsion and potential legal action.

11. Workshops and Educational Programs

Participation in workshops and educational programs is subject to age requirements and capacity limitations. Registration may be required for certain activities. We reserve the right to cancel or reschedule programs due to weather, insufficient enrollment, or other circumstances. Participants must follow instructor guidelines and safety protocols during all activities. Materials provided during workshops remain property of the park unless specifically designated as take-home items.

12. Environmental Responsibility

JoySprout Park is committed to environmental sustainability and conservation. All visitors must respect our gardens, wildlife, and natural resources. Littering is strictly prohibited, and we provide clearly marked recycling and composting bins throughout the park. Picking flowers, disturbing wildlife, or removing plants without permission is not permitted. We encourage all guests to participate in our environmental stewardship programs and teach children to respect nature.

13. Privacy and Data Protection

We collect and process personal information in accordance with our Privacy Policy and applicable data protection laws. Information provided during registration, bookings, or communications is used solely for park operations, customer service, and marketing with consent. We implement appropriate security measures to protect personal data. For detailed information about our data practices, please review our Privacy Policy available on our website.

16. Force Majeure

JoySprout Park is not liable for failure to perform obligations due to circumstances beyond our reasonable control including natural disasters, extreme weather, pandemics, government actions, labor disputes, or other force majeure events. In such circumstances, we may temporarily close facilities, cancel programs, or modify operations as necessary. We will make reasonable efforts to notify guests of closures and provide alternatives when possible, but are not obligated to provide refunds or compensation for force majeure events.

17. Dispute Resolution

Any disputes arising from these terms or your use of JoySprout Park facilities shall first be addressed through good-faith negotiation. If informal resolution fails, disputes will be resolved through binding arbitration in accordance with Australian arbitration laws. The arbitration will be conducted in the jurisdiction where our principal office is located. Each party bears their own costs unless otherwise determined by the arbitrator. These terms are governed by the laws of Australia.

18. Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the provision shall be severed from these terms. The remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

19. Changes to Terms

We reserve the right to modify these Terms of Service at any time to reflect changes in our operations, legal requirements, or business practices. Significant changes will be communicated through our website and, where appropriate, via email to registered users. The "Last Updated" date at the top of this document indicates when terms were most recently revised. Continued use of our facilities or services after changes take effect constitutes acceptance of modified terms.
